Estate Planning

From identifying all of your assets to determining your wishes, a lot of time and thought typically goes into planning for your estate. As a result, estate planning usually requires two meetings with the attorney. The first session is the opportunity to review assets, ask questions, and discuss available options in an attempt to make sure all of your wishes are taken into consideration. Estate planning does not just involve the preparation of a will and the distribution of assets upon your death; the preparation of various power of attorneys is also an important topic to cover during the initial consult. Once we develop a plan, then Katelyn will review the notes from our consultation and prepare the documents. The second meeting will be when you review the final documents with Katelyn, sign the approved documents, and then receive the original signed documents for your records and safekeeping.

Estate Administration

Estate administration requires opening an estate at the county courthouse and working with the Clerk of Court Estates Division to pay any outstanding debts and distribute the remaining assets of the estate. The Personal Representative (Executor or Administrator) will meet with Katelyn to get an initial overview of the process. Although the process may seem easy, the process can be lengthy and include many deadlines that must be met, which can be complicated by the impact of your loss. Katelyn’s role is to help the Personal Representative through the process by filing the necessary documentation with the Clerk’s Office and then keeping up with timelines for mandatory filings, notices that may be filed in the estate, and providing advice to the Personal Representative regarding assets, debts/creditors (if any), and the distribution of remaining assets.
